Licence to occupy

A Licence to Occupy is a legal document between two or more parties that allows someone other than the owner (a third party) to use a specific area of the owner's land for a permitted purpose. ​

A Licence to Occupy with KiwiRail records your right to use KiwiRail land and KiwiRail's obligations towards you.

What are the types of Licences to Occupy?

  • Commercial and industrial
  • Grazing and cropping
  • Beautification (e.g. mowing lawns)
  • Cycleways and pathways

If I don’t enter a Licence to Occupy, who maintains the land?

KiwiRail maintains the rail corridor itself and through agreements with local councils.
