Leases, licences and applications to occupy or use rail land.

Anyone using KiwiRail land needs a legal agreement giving them the right to do so.

The type of agreement will depend on what you want to do and whether the land is needed for current or future rail operations.

Lease land or buildings

KiwiRail may lease land or buildings that are not currently required for rail operations.

Licence to Occupy

A Licence to Occupy allows a person or organisation to use a specific area of KiwiRail land for an approved purpose.

This may include:

commercial or industrial use

grazing or cropping

community beautification or mowing

cycleways and pathways.

Licence to Occupy application

Grants

A Grant agreement may be required if you want to install, replace, maintain or upgrade an asset or structure on, over or under railway land.

This may include:

Level Crossings
pipes or cables

power or communications infrastructure

bridges or underpasses

water races or open drains

rights of way or pathways

structures or assets such as billboards.

If you require access to the rail corridor, you may need a Permit to Enter

A Lease, Licence to Occupy, or Grant agreement does not automatically give you permission to enter the operational rail corridor.
